Terms of Service

These terms cover general use of the MacKinnonTech website and the general relationship between MacKinnonTech and its customers. They work together with the more specific terms listed below — the terms that actually apply to your project are whichever ones match the service you requested.

What you are agreeing to

Using this website, or requesting a project through it, means you agree to these general terms plus whichever service-specific terms apply to your project.

What MacKinnonTech will do

Provide the described services in good faith, communicate clearly about scope and pricing, and get your approval before chargeable work begins.

What you must do

Give accurate information, respond to requests for approval, and confirm you have the right to authorize any device, account, or content involved.

What is not included

Anything outside the written scope of your specific project — including legal, tax, or compliance advice.

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of the MacKinnonTech website (mackinnontech.com) and any web development, PC repair, technology support, or related service requested from MacKinnonTech, an owner-operated business run by Jon MacKinnon.

By browsing this website, submitting a form, or requesting a service, you agree to these Terms. If you do not agree, please do not use the website or request a service.

For attorney review:the exact legal business name, business structure (sole proprietorship, LLC, or other), and business address have not been finalized for publication and are tracked as open items in MacKinnonTech's internal legal review.

2. Services Described

MacKinnonTech offers, subject to availability:

  • Website design and development
  • Ongoing website support and maintenance
  • General business technology support and consulting
  • PC diagnostics, repair, and cleaning
  • Hardware installation and upgrades
  • Windows installation
  • Malware removal
  • Performance optimization
  • Custom PC building
  • Cybersecurity-related services, where specifically agreed in writing

MacKinnonTech is primarily a web development business. PC-related services are provided as a drop-off service — see the PC Repair Terms for details.

3. Service-Specific Terms

These general Terms apply to everyone. Depending on what you request, additional terms also apply and take precedence for anything specific to that service:

4. Requesting a Service Does Not Create a Binding Agreement

Submitting a contact form, project request, or appointment request through this website is a request for MacKinnonTech to review — it is not, by itself, a final repair agreement or development contract. A binding agreement for chargeable work is formed only once MacKinnonTech provides an estimate, scope, or maximum authorized amount and you approve it, except for a separately approved diagnostic fee where applicable.

5. Pricing

Prices listed on the Pricing, PC Repair, and Custom PC Builds pages are described as fixed prices, starting prices, price ranges, hourly labor, monthly support, or custom quotes, as applicable. Website prices are general starting points and do not become a binding estimate until MacKinnonTech reviews the requested work and provides written confirmation. Parts, software licenses, shipping, taxes, subscriptions, premium assets, and third-party fees are not included unless specifically listed in a written estimate. Additional work will not be performed beyond an approved estimate or maximum authorized amount without your approval.

6. Accounts

This website does not currently offer customer account registration or login. Project and repair records are kept directly by MacKinnonTech through email, the booking form, and (where applicable) a private database used to store your submission. See the Privacy Policy for details.

7. Intellectual Property

Content on this website — including design, code, graphics, and written material — belongs to Jon MacKinnon / MacKinnonTech unless otherwise stated. See the Copyright & Use page for what is and is not permitted, and the Website Development Terms for how ownership works for a client project.

8. Third-Party Links and Services

This website may link to or rely on third-party services (for example, hosting, analytics, email delivery, or font providers). MacKinnonTech does not control those third parties and is not responsible for their content, availability, or policies. Using a third-party service linked from this site is subject to that provider's own terms.

9. Acceptable Use

You agree not to use this website to submit false information, attempt to interfere with its operation, upload unlawful content, or misrepresent your identity or authority to request a service. Full detail is in the Acceptable Use & Customer Content Policy.

10. Disclaimers

MacKinnonTech provides services using reasonable skill and care, based on the information and equipment provided at the time of service. Except as set out in the Warranty & Service Guarantee Policy, services are provided on an as-available basis. MacKinnonTech does not guarantee specific outcomes such as search engine rankings, malware-free operation, or permanent security — see the PC Repair Terms and Website Development Terms for accurate, specific language about what is and is not promised.

11. Limitation of Liability

To the extent permitted by law, MacKinnonTech's liability for a claim arising from a service is limited to the amount you actually paid for that specific service. MacKinnonTech is not liable for indirect, incidental, or consequential losses — including lost profits, lost data beyond what is addressed in the PC Repair Terms, or business interruption — except where such a limitation cannot legally apply.

This limitation does not apply to, and does not attempt to waive, liability for intentional misconduct, gross negligence, or any right that cannot be waived under applicable law.

For attorney review: a specific liability cap amount, and whether a different cap is appropriate for higher-value website projects versus PC repair work, has not been finalized by MacKinnonTech and should be confirmed with an attorney before being relied upon in a dispute.

12. Governing Law and Disputes

MacKinnonTech operates from Japan and serves both local and remote customers, including members of the U.S. military community. The specific governing law, venue, and dispute-resolution process for these Terms have not yet been finalized and are under legal review. Until that review is complete, no exclusive governing law, mandatory arbitration, jury-trial waiver, or class-action waiver is asserted by these Terms.

If you have a dispute or concern, please contact MacKinnonTech directly first — most issues can be resolved without any formal process.

13. Changes to These Terms

MacKinnonTech may update these Terms from time to time to reflect changes in services, business practices, or applicable law. Updates apply prospectively from the date they are posted. The “Last updated” date above reflects the most recent revision.
