These terms apply to website design, development, and ongoing support projects. They work alongside the general Terms of Service and the written proposal or estimate for your specific project.
The written proposal or approved estimate defines your project's scope. Anything not specifically included is outside scope and handled as a change request.
Build what was scoped, ask for your approval at key milestones, and be clear about what a project does and does not include.
Provide accurate business information, required content, timely feedback and approvals, and confirm you have the rights to any content you supply.
Anything outside the written scope — including ongoing maintenance beyond what you've purchased, continuous security monitoring, or guaranteed search rankings.
The written proposal, statement of work, or approved estimate for your project defines what is included. Anything not specifically included in that document is outside scope and is handled as a change request under Change Requests below.

MacKinnonTech has not yet finalized standard deposit percentages, payment schedules, late-payment terms, or cancellation charges for website projects.
Internal item: deposit amounts, payment milestones, late fees, and cancellation charges are confirmed with you directly in your written proposal until a standard policy is finalized. See Cancellation, Refund & Deposit Policy for the current state of that decision.
Ownership of a website project is not all-or-nothing — different parts work differently:
For attorney review: the precise legal language for license grants, source-code escrow (if any), and final ownership transfer conditions has not been reviewed by an attorney and should be before being relied on for a high-value project.
By providing logos, photographs, text, video, trademarks, software, data, or other material for your project, you confirm that you have the rights to use and publish that material, and that doing so does not infringe anyone else's rights. MacKinnonTech does not accept an unlimited indemnity obligation from you without a separately reviewed agreement for larger projects.
Website projects commonly depend on third-party services, which may include:
MacKinnonTech does not control these providers' uptime, pricing, policy changes, account suspensions, or discontinuation, and is not responsible for their failures. This does not excuse MacKinnonTech's own negligent configuration or implementation of a third-party service within your project.
Reasonable security practices can reduce risk but cannot eliminate all vulnerabilities or attacks. Security work is defined by the written scope of your project. Ordinary website development does not include continuous monitoring, penetration testing, regulatory compliance certification, incident response, or unlimited future patching unless your scope specifically includes them — see Cybersecurity & Awarenessfor what MacKinnonTech's standard security work covers.
MacKinnonTech applies accessible design practices — semantic HTML, labeled form fields, sufficient color contrast, and keyboard-navigable interactive elements — as a standard part of development. This does not amount to a guarantee of compliance with every accessibility law or standard (such as full WCAG conformance or ADA compliance) unless a specific compliance scope has been contracted and independently tested for your project. MacKinnonTech implements SEO best practices — clean metadata, sitemaps, semantic structure, and performance optimization — as part of standard development. MacKinnonTech does not guarantee first-page rankings, a specific search position, a specific traffic increase, a particular number of leads, immediate indexing, or permanent rankings. Search engines control their own ranking algorithms, which are outside MacKinnonTech's control.
A website project involves several distinct phases, which are not the same thing:
“Ongoing support” describes a defined, recurring scope of work — it does not mean unlimited work of any kind at any time.
